Small Business Majority tagged out

Well, that was quick.

Two days ago, I posted about the Small Business Majority’s motion to intervene in the 5th Circuit appeal by the FTC. Essentially, the Small Business Majority sought to step in to try to keep the FTC’s noncompete rule alive in light of the FTC’s anticipated dismissal of its appeal. As noted, the Small Business Majority sought to intervene in both the 5th and 11th circuit appeals.

While the 11th Circuit has not yet ruled, the 5th Circuit has.

No surprise, the 5th Circuit denied the motion.
